Cooper Tire & Rubber and Apollo Tyres of India are still fighting each other in a Delaware court following the failed sale of the company last year. Cooper officials claim an agreement made by the two companies means that since Apollo didn’t complete the deal, they owe the Findlay based company $112.5 million. Apollo lawyers counter that because Cooper wasn’t in “a position to close the deal,” they can’t sue for damages.
The two sides are once again battling it out in front of Delaware Chancery Judge Sam Glasscock. Apollo wants Glasscock to rule on the issue. If he rules in their favor, they can then ask an appellate court to rule that Apollo wasn’t responsible for the deal going south.
