Findlay Woman’s Fraud Conviction Overturned

A Findlay woman’s insurance fraud conviction was narrowly overturned by the Lima Third District Court of Appeals. The Courier reports 45 year-old Holly Kaczmarek won her appeal with a 2 to 1 decision. Kaczmarek was found guilty of insurance fraud in July of last year in Hancock County Common Pleas court. The jury said she defrauded her insurer through a deceptive statement after a June 2011 break-in in which her apartment was vandalized and items were reported stolen. The appeals court said prosecutors failed to show sufficient evidence that Homesite Insurance was certified to operate in Ohio. The case goes back to Hancock County. No hearing has been scheduled.
