Judge Tosses Most Claims In Case Filed Against Board Of Health
(WTOL-11) – A judge has thrown out three of four claims Win Waste filed against the Seneca County Board of Health.
Win Waste, which operates the county landfill, claimed the board violated Ohio’s open meetings law.
But, the judge disagreed, ruling the company did not provide enough evidence and waited too long to file a lawsuit.
The legal fight stems from a long-running dispute over how the landfill is operated.
Win Waste says the county has been requiring more than state and federal regulations demand.
The board of health argues those extra conditions are necessary to protect nearby residents and the environment
One claim remains active in the case and the board of health has 30 days to decide whether to appeal the ruling.
